Music & Media Policy

The purpose of this statement is to disclose Festivity Entertainment’s (“we”, “us”, or the “DJ”) policy on music and media as it pertains to client (“you”, “your”) requests, guest requests, fair use, and copyright law. Music and other forms of media such as video and print collectively referred to as (“Media”). Policies regarding music and copyright law, or explicit music, also apply to other forms of media.

Media Sources

Due to federal copyright law Festivity Entertainment can only play music legally purchased from legitimate sources such as retailers and licensed DJ music services. We will not play music live or “ripped” from streaming sources such as YouTube, Spotify, Pandora, or simiar sources. Copyright law violations carry heavy civil and criminal penalties including fines up to $250,000 and 5 years in prison, and we must avoid exposing us or our clients to such penalties. Likewise the DJ will only play music from his/her own collection at the event, as we prefer to purchase songs for you prior to the event when possible. We kindly ask you to discuss options with us during your pre-event consultations.

Explicit Music

The DJ has the ultimate authority and right to refuse playing music with explicit lyrics. This includes songs labeled as “Explicit” or otherwise contain overt profanity, overly vulgar lyrics, racial or ethnic slurs, or songs that would otherwise make guests or others uncomfortable at the event. The DJ will make that judgement call and work with you to see if a “clean” version of a song can be substituted. Please note record companies do not always release “clean” versions of songs. We kindly ask you make music choices that help us keep your event fun for everyone of all ages, and we are more than happy to help with any music questions during our consultations.

Music Requests

The DJ will make his/her best effort to keep in line with your wishes and accommodate music requests, giving precedence to the Bride and Groom’s wishes at a wedding, otherwise the client on the contract and/or guest of honor at other events. The DJ will make best effort to play guest requests if he/she has the song, is able to fit the song in, and has time to play it. Since the DJ can only play a finite number of songs and has to keep in line with continuity of the event, he/she will be the ultimate authority on whether or not all requests can be played. We kindly ask you discuss handling music requests with us prior to the event, and we will be more than happy to help.
